The council asks who will hold and manage the licence, what accommodation is occupied and which documents support it. Start with the real arrangement today, including any flat within a larger building, rather than an old floor plan or marketing description.

People, households and letting basis

List every adult and child whose main home is the property, show which residents form a family or other single household and record their room or unit. State whether occupation is under one joint tenancy, separate room agreements, licences, company arrangements or a resident-landlord letting. Counting agreements, bedrooms or rent payments alone does not establish the statutory household position.

House, shared flat or converted block

It applies throughout the borough to qualifying section 254 HMOs occupied by three or more people in two or more households and to section 257 converted blocks where the building and every dwelling are in the same ownership or considered effectively under the same control. HMOs subject to mandatory licensing or another stated exclusion do not use the additional route.

2. Check the planning land and use date

Establish when the current HMO use began and retain permissions, lawful-use decisions or robust occupation records.
